Recent developments in vicarious liability

Vicarious liability arises most commonly in employment contexts. Recent decisions have tested the scope and boundaries of this doctrine, culminating in the recent High Court decision in Bird v DP [2024 HCA 41]. We’ll explore the current boundaries of the doctrine and explore where these may continue to be tested.
By the end of this activity, participants will be able to:
• Identify and understand vicarious liability issues, including how they relate to employment contexts
• Understand the impact of recent court decision on vicarious liability, and how the doctrine of vicarious liability may evolve further
• Understand the impact of these changes on the risk framework for writing EPL and similar policies
• Understand the potential impact on their own business practices
