The Weinstein effect: The new horizon in EPL risks
Allegations of sexual harassment and other inappropriate behaviour against high-profile Hollywood figures, such as Harvey Weinstein and Kevin Spacey, have sparked the #metoo campaign – a forum for women to come forward and tell their stories, with global reach and impact.
This has been named ‘The Weinstein effect’. As more people speak publicly about their experiences, an increase in claims is a certainty.
It is vital the insurance industry is equipped to consider the ramifications of the role of the media and social media in amplifying this emerging risk.
Sexual harassment, bullying and discrimination are not the only possible sources of legal claims – workplace health and safety and D&O duties to shareholders must be considered.
This seminar examines the state of play in the United States and Australia, and considers the role of the media, social media, and the courts in responding to these risks and resulting claims.
It also discusses claims management strategies, particularly where there are multiple claimants and diverse legal obligations.
