We have had more brokers approaching our firm to undertake legal work for their clients prior to renewal to actually reduce the likelihood of future claims rather than merely telling a story of the risk. We have re-drafted sub-consultant agreements to tighten up terms\, advised on risk retainer documents and produced reports for insurers which are provided at renewal to explain clients with substantial claims. This is a topic where we can help brokers with complex renewals and can give an overview of the types of claims we are seeing for building practitioners (structural and geotechnical engineers\, building surveyors and builders/developers). DESCRIPTION:Hamish McDonald Nye\, Blair McNamara and Katy Gale \nSince Steadman v Greater Western Water Corporation was handed down in the VCAT it has been established that the Limitation of Actions Act 1958 (Vic) (this is the statute of limitations in Victoria) does not apply to limit time to file claims where VCAT has exclusive jurisdiction. This is a significant topic given I recently heard a broker say to his client that a 7 year run off policy will cover any future claim – wrong! 6 years plus a year for service is a rule of thumb that can in certain circumstances be helpful but but even standard building claims can be made up to 10 years from the issuance of a certificate of occupancy in Victoria. This topic can assist brokers in understanding the complexity of time limitations and to avoid advice. DESCRIPTION:Hamish McDonald Nye\, Blair McNamara and Katy Gale \nSince Burns v Corbett in the High Court of Australia there have been various cases which have limited the Tribunal’s ability to hear matters in its jurisdiction. This has been a major issue where a party is a resident of another state (eg. landlord) and the Tribunal cannot hear the matter. This limitation of the Tribunal extends to other areas including contribution claims under the Wrongs Act not being allowed in the Tribunal. New legislation is on the way but VCAT is facing many jurisdictional issues.
