WEBINAR: Time limits at VCAT

Since Steadman v Greater Western Water Corporation was handed down in the VCAT it has been established that the Limitation of Actions Act 1958 (Vic) (this is the statute of limitations in Victoria) does not apply to limit time to file claims where VCAT has exclusive jurisdiction. This is a significant topic given I recently heard a broker say to his client that a 7 year run off policy will cover any future claim – wrong! 6 years plus a year for service is a rule of thumb that can in certain circumstances be helpful but but even standard building claims can be made up to 10 years from the issuance of a certificate of occupancy in Victoria. This topic can assist brokers in understanding the complexity of time limitations and to avoid advice.
